Segregation of Individuals with Mental Illness in Adult Homes
Disability Advocates, Inc. v. Pataki, et al.
No. 03-CV-3209 (EDNY 2003)
In 2003, Disability Advocates, the Bazelon Center for Mental Health Law, New York Lawyers for the Public Interest, MFY Legal Services, Inc., Paul, Weiss, Rifkind, Wharton & Garrison, LLP, and the Urban Justice Center filed this lawsuit on behalf of approximately 4,000 residents of adult homes with serious mental illness in New York City. The lawsuit alleges that New York State is violating the Americans with Disabilities Act and other laws by segregating people with psychiatric disabilities in unsafe and unsanitary institutional adult homes instead of providing community-based treatment and support.
